Profs. Kevin Outterson and Abby Moncrieff filed amicus briefs in the recent cases before the Supreme Court on the Patient Protection and Affordable Care Act. Prof. Outterson authored an amicus brief in Dept. of Health & Human Services v. Florida, No. 11-398 on the question of the constitutionality of the minimum coverage provision focusing on Article I of the Constitution with the help of students Kyle Thomson, David J. Arnold, Julia Grace Mirabella and Hao Wong, and joined by Profs. Partan and Sloane. Prof. Outterson also participated in the amicus brief on behalf of Health Care for All. He authored an amicus brief in Florida v. Dept. of Health & Human Services, No. 11-400 on the Medicaid expansion in section 2001(a)(1)(C) of the Act. Prof. Moncrieff joined an amicus brief, together with her students Zoe Sajor, Rachel Smit and Emily Westfall, in 11-398 on the question of the constitutionality of the minimum coverage provision focusing on the Commerce Clause and the Necessary and Proper Clause.
